Terms of Service

Welcome to ProtocolRX. These Terms of Service (“Terms”) govern your access to and use of protocolrx.comand any related products, applications, and services provided by ProtocolRX (collectively, the “Service”). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. Some prescription products may only be available in specific U.S. states. By using the Service, you represent that you meet these requirements and that the information you provide is true and accurate.

2. Not medical advice

ProtocolRX provides educational content, supplement sales, and a software platform that connects you with independent, licensed healthcare providers through our telehealth partner. ProtocolRX is not a medical practice. Information on the Service is for educational purposes and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions about a medical condition.

If you are experiencing a medical emergency, call 911 or your local emergency number.

3. Telehealth and prescriptions

Prescription products are evaluated and prescribed by independent licensed healthcare providers (“Providers”) engaged through our telehealth partner. The Provider, not ProtocolRX, is responsible for the clinical decision to prescribe or to decline. By submitting a telehealth intake, you authorize the Provider to evaluate your request, communicate with you, and, if appropriate, write a prescription that may be filled by a partnered 503A or 503B compounding pharmacy or other licensed pharmacy. Prescriptions are written at the Provider’s sole discretion and may be declined.

You agree to provide accurate, complete medical history, current medications, allergies, and identity information. Misrepresentation may result in denial of service and cancellation of orders.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@protocolrx.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a risk to other users or to safety.

5. Orders, pricing, and payment

  • Prices are listed in U.S. dollars and may change at any time. We will charge the price in effect at the time you place the order.
  • Payment is processed by Stripe. By providing payment information, you authorize the charge for the order total and any applicable taxes and shipping.
  • For prescription products, your card may be authorized at order placement and charged after the Provider’s decision. If the request is declined, you will not be charged or you will receive a full refund.
  • We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, unavailability, or pricing errors.

6. Refunds and returns

Refunds and returns are governed by our Returns & Refund Policy, which is incorporated into these Terms by reference. Prescription products and controlled substances generally cannot be returned once dispensed.

7. Shipping

Shipping times are estimates and not guaranteed. Risk of loss for non-prescription products passes to you on delivery to the carrier. For prescription products, the dispensing pharmacy’s policies apply.

8. Acceptable use

You agree not to:

  • Use the Service in any way that violates any law or regulation, including the U.S. Controlled Substances Act.
  • Resell, divert, or share prescription products. Prescriptions are dispensed for your personal use only.
  • Interfere with or disrupt the Service, attempt to gain unauthorized access, or probe for vulnerabilities.
  • Scrape, copy, or use automated means to access the Service except as expressly permitted.
  • Misrepresent your identity, age, or medical history.

9. Intellectual property

The Service, including its content, logos, designs, and software, is owned by ProtocolRX or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy. ProtocolRX does not warrant that the Service will be uninterrupted, error free, or secure. Statements about supplements have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease.

11. Limitation of liability

To the maximum extent permitted by law, ProtocolRX and its officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or in connection with the Service. Our aggregate liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars.

12. Indemnification

You agree to indemnify and hold harmless ProtocolRX from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration in Wilmington, Delaware under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may bring an individual claim in small-claims court. You and ProtocolRX waive the right to a jury trial and to participate in any class action.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes will be communicated more prominently (such as by email or in-app notice). Your continued use of the Service after the change becomes effective constitutes acceptance.
